Success against Motion for Interim Recovery of Car

Justice Belobaba of the Ontario Superior Court of Justice delivered a judgment in favour of Cohen, Sabsay LLP's corporate client. The client, a car leasing company, was the victim of a fraudulent claim for a repair lien on a car it had leased to a customer. The customer had stopped paying and no one understood how the lien claimant obtained possession of the client's car. The client refused to pay the repair lien amount, alleging that the lien claim was fraudulent. The client was able to repossess the car once it had been subsequently sold to a third party. The third party brought a motion to have the car returned from our client.
